Fee Policy

This Madilyn James Fee Policy (this “Policy”) describes the fee structure that Madilyn James, LLC (hereinafter, “Madilyn James,” “we,” “us,” or “our”) provides to sellers on the Madilyn James platform, including the Madilyn James website located at https://madilynjames.com/ (the “Site”) and mobile app (on any and all formats or devices) (the “App”) (the Site and the App, and the services, content and other materials made available through the Site and the App are referred to in this Policy as the “Service”). This Policy is subject to the Madilyn James Terms of Service located at https://madilynjames.com/terms-and-conditions (the “Terms of Service”) and the Terms of Service are incorporated into this Policy by this reference.

1) Fee structures

Madilyn James offers several fee structures under which sellers are charged a Commission on each sale through the Service. Sellers may also choose to enroll in a subscription, which is subject to a separate Subscription Fee. Commissions will be paid to sellers thirty (30) days following completion of an applicable sale through the Service. For the avoidance of doubt, Commissions are not payable with respect to refunded sales.

2) Commission for each sale through the Service:

Madilyn James offers a base-fee product for sellers who prefer not to enroll in a recurring subscription. The fee structure is as follows:

Madilyn James also offers two other products subject to a Subscription Fee. The Subscription Fee may be paid either on a monthly or annual basis, as elected by the seller at the time of subscription.

Madilyn James reserves the right to provide promotional offers with special or different fee structures. Madilyn James will provide information about the alternative fee structure at the time of the applicable promotional offer. Madilyn James further reserves the right to establish the eligibility criteria for promotional offers, and promotional offers may not be made available to all sellers. The terms of this Policy will apply unless Madilyn James confirms in writing that an alternative fee structure applies to a seller’s sales through the Service.

Madilyn James also may modify the amount, frequency, or structure of the Commissions or Subscription Fees from time to time upon providing notice to sellers in accordance with Section 6.4 of the Terms of Service. However, the Subscription Fee terms, if applicable, that applied at the time a seller initiated its subscription will apply through the end of the then-current subscription period.

3) Definitions:

“Commission” means the fee calculated as a percentage of the applicable gross transaction amount for a sale through the Service, excluding taxes, shipping charges, and refunds, unless otherwise specified in writing.

“Subscription Fee” means the recurring fee charged by Madilyn James for access to certain products or services, payable on a monthly or annual basis (as elected by the seller), unless otherwise specified in writing. For clarity, sellers who elect a monthly subscription will be billed each month, and sellers who elect an annual subscription will be billed once per year in advance.
